THE AGREEMENT BETWEEN THE
BOARD OF SCHOOL TRUSTEES OF THE SCHOOL CITY OF HOBART 
AND
SERVICE EMPLOYEES INTERNATIONAL UNION, LOCAL 1-DIVISION 208
1997-98

ARTICLE II
DUES DEDUCTION

 


1. The school employer shall provide dues deduction rights to those employees covered hereunder who voluntarily authorizes a wage assignment for union dues. Dues will not be deducted for any period where the employee's net salary, after other legal and required deductions, is insufficient to cover the amount of authorized allotment for dues. The dues for which allotments may be made are the regular periodic amounts required to maintain an employee as a member in good standing of the labor organization and initiation fees. Special assessment, back dues, fines, and similar items are not considered to be dues. Dues shall cease when an employee ceases to be a member in good standing with the Union.

Effective January 1, 1984, the school employer will permit Union members to deduct from wages one additional assignment mutually agreeable between the Union and the Board.

2. It is further understood and agreed that the school employer shall not be required to deduct said dues or to remit same to Union Local 1-Division 208, when any employee covered hereunder has previously filed a written authorization requesting such deductions, requests in writing that the school employee cancel all or any portion of the deductions previously authorized.

3. SEIU, Local 1-Division 208, as the exclusive representative of the unit set forth herein shall have the exclusive right to dues deduction for employees in this unit.

4. Use of Inter-School Mail System: The Union shall be permitted the use of the school corporation's inter-school mail system for the distribution of Union communication pursuant to lawful bargaining responsibilities. A copy of general newsletters distributed in this manner will be given to the central office administration at the time of distribution.

5. Agency Shop
Effective January 1, 1989, and thereafter in order for a custodial unit member to become a permanent employee qualifying for the benefits of this Agreement, he or she must execute and continue to keep in effect, a wage assignment agreement for union dues, regular and periodic dues, initiation fee and other uniform assessments, or he or she must execute and continue in effect a wage assignment for an Agency Shop fee. This provision is not applicable to employees in the custodial unit as of the effective date of this contract who are not Union members. Any employee who is currently a member of the Union must continue his or her current wage assignment agreement for Union dues, initiation fee and other uniform assessments, or he or she must execute and continue a wage assignment of an Agency Shop fee.

6. Union Stewards
It is agreed that the Union may establish a steward system within the provisions of this section. The Union shall notify the Employer annually in writing of the names of the employees named as stewards. The Union agrees that the steward shall perform his/her duties as expeditiously as possible and shall not interfere with the duties of employees or normal operation of the schools. When visiting a building in his/her capacity as Union Steward, the Steward shall check in with the office of Support Services and the school office before visiting the school employees. The designated Union Steward shall perform his/her steward duties during his/her off duty time. The Union Steward may be permitted to perform his/her duties during working time with the prior approval of the Director of Support Services.

7. Union Visitation
The union staff member assigned to service the bargaining unit shall have the right to visit work locations for the purpose of insuring that the Agreement is being complied with and meeting with administrators on grievances, provided, however, that such visits shall be conducted as expeditiously as possible and shall not interfere with the duties of the employees or the normal operation of the schools. The Union shall notify the Employer annually in writing of the names of the union staff member and alternate staff member assigned to service the unit. When visiting a building the union staff member shall inform the office staff that he is in the building. In addition, the union staff member shall inform the office of Support Services that he is visiting the building. Meetings with administrators shall be arranged in advance for mutually agreeable time and date.
